it just isn’t right

i know it isn’t right, and i tried to do something about it but i couldn’t

without giving too much detail I will tell you what is going on then ask for your opinion

the fence behind our house was falling over. the fence is about 20 years old. the hoa had someone out to give a bid on a new fence. they also said there needed to be a retaining wall. the hoa would pay for the fence and we would have to cover the retaining wall. they gave us the bid from the guy they brought out. we told them that we would like to hire our own person to do the wall since we would have to pay for it. they decided to schedule the guy to do both anyway. he started this morning. we never said ok…go ahead…we approve or anything close to that. we have never even seen the bid, just heard about it. yet they are out there now building a wall that we are supposed to pay for. i told the contractor that we didn’t authorize the wall but he could do the fence. he said they are all one piece and they have to be built together and he was hired by the hoa to do the job.

so what do you think?

If you didn’t authorize it, you shouldn’t have to pay for it. On the other hand, you might want to check your HOA rules. There might be something in there stating they can authorize it and you have to pay.

As the current president of our HOA, I say they are going to get stuck having to pay for the entire repair. You could always refer to the CC&Rs, but really, without anything agreed upon? It’s like the HOA wanted to pay for the whole job!
